Matric Results Must Be Published In Newspapers – Says Court

After a week of uncertainty, the courts have decided that the Class of 2021’s results will be published on all media platforms.

Judge Millar has ordered the Department of Basic Education (DBE) to make the National Senior Certificate (NSC) results available to those who have requested it. This decision took place in the North Gauteng High Court in Pretoria. This will allow media houses to publish the 2021 matric exams in newspapers.

The DBE announced they will abide with the ruling made by the Pretoria High court.

The department said, ‘the conditions of the court ruling must be taken into account in line with the provisions of the Protection of Personal Information Act 4 of 2013’.

Court action was pursued by AfriForum after the DBE announced that individual learner’s results will no longer be published in newspapers and online platforms. The organisation welcomed the court’s decision.

Natasha Venter, Manager of Education Rights at AfriForum said “It is in the public interest that this information is shared on public platforms and that is one of the reasons why we brought this application. We are delighted that the court agreed with us in this argument”.

AfriForum’s Attorney Willie Spies says they are happy that the minister has accepted the ruling and will apply it. He says this is different from the usual events that follow public litigation.

Spies said, “It could have been very easy for the minister to brief advocates and to put up a big fight and to try and frustrate this process. So while we are glad about the victory, we are also glad about the wisdom that was displayed by the minister herself in dealing with this matter”.

The DBE has also urged learners to register on their website in order to access their results. The website is zero-rated, meaning that students will be able to access their results even if they do not have data. More than 10 000 people have already registered on the website.

In order to register on the DBE’s websites, matriculants will need to provide both their 13-digit ID numbers along with their examination numbers.
